Welcome to ListPronto. These Terms of Use ("Terms") govern your access to and use of the ListPronto website, application, and AI-powered real estate copywriting services (collectively, the "Service").

By accessing, registering for, or using the Service, you ("User", "you") agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.

1. Description of Service

ListPronto provides an artificial intelligence (AI) powered workflow engine designed to assist real estate professionals in drafting property descriptions, social media posts, and related marketing materials. The Service utilizes third-party APIs, public records data scraping, and large language models (LLMs) to generate this content.

2. EXPLICIT USER RESPONSIBILITY AND LIABILITY FOR AI CONTENT

THIS SECTION CONTAINS CRITICAL LEGAL DISCLAIMERS REGARDING YOUR LIABILITY. PLEASE READ CAREFULLY.

ListPronto provides a drafting assistant tool. Because Artificial Intelligence is an emerging technology, it is prone to errors, inaccuracies, "hallucinations," and omissions. Furthermore, real estate advertising is heavily regulated by local, state, and federal laws, including the Fair Housing Act and Multiple Listing Service (MLS) guidelines.

By utilizing our Service, you explicitly acknowledge and agree to the following:

  • MANDATORY DOUBLE-CHECKING: You are strictly and solely responsible for reading, reviewing, fact-checking, editing, and verifying the accuracy of ALL AI-generated content produced by ListPronto BEFORE publishing, posting, emailing, or distributing it in any capacity.
  • ASSUMPTION OF SOLE LIABILITY: You act as the final publisher and author of the content. THE USER IS HELD ENTIRELY LIABLE for the final published material. ListPronto bears zero responsibility for the factual accuracy of the generated text, including scraped public records (e.g., square footage, bed/bath counts, lot size).
  • FAIR HOUSING & COMPLIANCE: While ListPronto attempts to implement Fair Housing compliance guardrails, we do not guarantee that the generated output complies with the Fair Housing Act, local real estate commission rules, or your specific MLS regulations. It is your duty to ensure compliance.
  • FULL INDEMNIFICATION: IF ANY LEGAL ACTION, LAWSUIT, FAIR HOUSING VIOLATION, MLS PENALTY/FINE, CLIENT DISPUTE, OR FINANCIAL LOSS IS TAKEN OR LEVIED DUE TO YOUR POSTING OR USE OF CONTENT GENERATED BY LISTPRONTO, YOU ASSUME FULL LEGAL AND FINANCIAL LIABILITY. You agree to indemnify, defend, and hold harmless ListPronto, its founders, employees, and affiliates from any and all claims arising from the content you publish.

3. Account Registration & Security

To use the Service, you must create an account. You agree to provide accurate and complete information during registration. You are responsible for maintaining the confidentiality of your password and account credentials. You agree to notify us immediately of any unauthorized use of your account.

4. Subscription, Billing, and Cancellation

Plans: ListPronto operates on a subscription basis (e.g., Basic, Pro, Ultra). Features, usage limits, and pricing are detailed on our Pricing page and are subject to change.

Payments: By subscribing, you authorize us (via our third-party payment processor, e.g., Stripe) to charge your selected payment method on a recurring basis.

Cancellations: To cancel your subscription, email us at listpronto@gmail.com from the email address associated with your account, stating the reason for your cancellation. An administrator will review and process your request, and you will receive written confirmation once the cancellation has been applied. Please allow up to five (5) business days for processing. Cancellations take effect at the end of your current billing cycle, and you retain access to your plan until that date. We do not offer prorated refunds for mid-cycle cancellations.

Usage Limits: If you exceed the generation limits of your specific tier, your access to generation features will be paused until the next billing cycle or until you upgrade your plan.

5. Intellectual Property Rights

Our Platform: ListPronto retains all right, title, and interest in and to the Service, including all software, design, UI/UX, and underlying AI prompt architecture. You may not reverse-engineer, copy, or distribute our proprietary code.

Your Inputs & Outputs: You retain ownership of the original text and images you upload to the Service. ListPronto grants you a perpetual, worldwide, commercial license to use, modify, and publish the text generated for you by the Service.

6. Prohibited Conduct

You agree not to:

  • Use the Service for any illegal, fraudulent, or malicious purpose.
  • Attempt to bypass, exploit, or manipulate our rate limits or credit systems.
  • Use automated scripts, bots, or web scrapers to extract data from ListPronto.
  • Input sensitive personal data (e.g., Tax Numbers, financial data) into the property description fields.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS. LISTPRONTO DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY ACCURATE.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL LISTPRONTO BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR USE OR INABILITY TO USE THE SERVICE; OR (B) ANY CONTENT GENERATED BY THE SERVICE. IN NO EVENT SHALL OUR AGGREGATE LIABILITY EXCEED THE AMOUNT YOU PAID TO US IN THE PAST ONE (1) MONTHS.

9. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify users of significant changes via email or a dashboard notification. Your continued use of the Service after changes become effective constitutes your acceptance of the revised Terms.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State in which ListPronto is headquartered, without regard to its conflict of law provisions.
